Terms of Service

1. Agreement

These Terms govern your use of Globomate ("Service"), provided by Globomate ("Globomate", "we", "us"), reachable at globomate.eu. By creating an account or using the Service you agree to these Terms. If you do not agree, do not use the Service.

2. The Service

Globomate is an AI assistant that connects to your business mailbox (Gmail or Outlook) and drafts replies to customer messages. Drafts are suggestions; you are responsible for reviewing them before sending. Globomate does not send messages on your behalf without your action unless you have explicitly enabled an automation that does so.

3. Eligibility & accounts

You must be at least 18 and able to enter a binding contract. You are responsible for the security of your credentials and for all activity under your account. Notify us immediately at support@globomate.eu if you suspect unauthorised access.

4. Plans, billing and trial

• Plans and prices are listed at /pricing and are billed in EUR, monthly, in advance.
• Trials, when offered, convert to a paid subscription unless cancelled before the trial ends.
• You can cancel at any time; cancellation takes effect at the end of the current billing period. We do not refund partial months unless required by law.
• We may change prices with 30 days notice. Continued use after the effective date constitutes acceptance.

5. Acceptable use

You agree not to:

• Use the Service to send spam, scams, harassment or unlawful content.
• Process special-category personal data (health, biometric, etc.) without a lawful basis and adequate safeguards.
• Reverse-engineer, scrape or attempt to bypass usage limits or security controls.
• Resell or white-label the Service outside an Enterprise agreement.

6. Your content & AI output

You retain all rights to the email content you process and to the drafts you generate ("Your Content"). You grant Globomate a limited licence to host, process and display Your Content solely to operate the Service. AI-generated drafts are provided "as is" and may contain errors; you are responsible for reviewing them before use.

7. Privacy & data protection

Our processing of personal data is described in our Privacy Policy. Where Globomate acts as a processor for your end-customers' personal data, our Data Processing Agreement (available on request) applies.

8. Third-party services

The Service relies on Google, Microsoft, OpenAI and other providers. We are not responsible for outages or changes to their APIs that may temporarily affect functionality.

9. Warranties & disclaimers

The Service is provided "as is" and "as available". To the maximum extent permitted by law we disclaim all implied warranties, including merchantability, fitness for a particular purpose and non-infringement.

10. Limitation of liability

To the extent permitted by law, Globomate's aggregate liability for any claim arising out of these Terms is limited to the fees you paid in the 12 months before the event giving rise to the claim. We are not liable for indirect, incidental or consequential damages, including lost profits or lost data. Nothing in these Terms limits liability for gross negligence, wilful misconduct or any other liability that cannot be excluded by law.

11. Suspension & termination

We may suspend or terminate your account for material breach of these Terms, non-payment, or to comply with law. You may close your account at any time from your profile settings.

12. Governing law

These Terms are governed by the laws of the European Union and the country in which Globomate is established, without regard to conflict-of-law rules. Disputes shall be brought before the competent courts of that jurisdiction, subject to any mandatory consumer protection rules of your country of residence.

13. Changes to the Terms

We may update these Terms. Material changes will be notified by email or in-app at least 14 days before they take effect. Continued use after that date constitutes acceptance.
